Terms of service

1. General

These terms govern the site mivly.pl and the purchase of the Mivly SaaS subscription by Maciej Paszka, a sole trader operating under the business name MPS-STAL, tax ID 6452592522, REGON 541196085, CEIDG registration, no KRS number, ul. Stalowa 17 Bud. 65, 41-506 Chorzów, Poland (the “Provider”).

Browsing the site does not conclude an ERP service contract. The SaaS agreement is concluded in the panel at erp.mivly.pl: at registration and, before payment, by accepting the terms next to the “Order and pay” button. The price, delivery, refund, complaint and seller details below are also published on this site. The full product contract is in the panel and prevails for use of the Service.

The Polish version is binding; the English version is a convenience translation.

2. Definitions

• Provider - Maciej Paszka (MPS-STAL), tax ID 6452592522, REGON 541196085; product and service brand: Mivly.
• Site - the informational website mivly.pl and the contact / callback forms.
• ERP service - the SaaS platform at erp.mivly.pl, covered by a separate product terms document.
• User - anyone using the Site.
• Form - contact and callback booking.

3. Scope of electronic services

On the Site the Provider free of charge: publishes information about Mivly, lets you send an enquiry or book a call, and points you to demo sign-up in the ERP panel.

Custom work is scoped in a separate agreement. SaaS fees and ERP data follow the panel terms and the chosen plan at erp.mivly.pl.

4. Technical requirements

A current browser with JavaScript and an internet connection are required. Forms use Cloudflare Turnstile. Essential security cookies must not be blocked if you want to submit a form.

5. Acceptable use

Use the Site lawfully. Unlawful, vulgar or infringing content and automated abuse of forms are forbidden.

6. Copyright

Site content belongs to the Provider or is used with permission. Copying without consent is prohibited.

7. Liability

We aim for accurate marketing information but site copy is informational and may change.

We are not liable for downtime caused by maintenance, technical issues or force majeure. ERP service liability is set out in the panel terms.

8. Buying a subscription

The Mivly subscription is an electronic service (SaaS), not goods. Prices are net amounts in PLN for the whole period: a month or a year. We add 23% VAT. The order shows net, VAT and gross. There is no shipping fee and no other charge.

Delivery is electronic only, to the account at erp.mivly.pl. Access starts as soon as the payment is booked, and no later than within 1 business day. Access lasts for the paid period. You need a current browser with JavaScript and essential cookies, and an internet connection.

We sell in PLN. The account has no territorial block. Polish law applies.

9. Refunds

There is no address for returning goods and no return-shipping cost. By clicking “Order and pay”, the buyer asks the digital service to start before 14 days and acknowledges loss of the right of withdrawal under Article 38(1) and (13) of the Polish Consumer Rights Act, where those rules apply. The fee for a period that has started is not refunded. To end the contract for the future, close the organisation in the panel or email [email protected].

If mandatory law still grants withdrawal, send the statement to [email protected] within 14 days. The payment is refunded via the same channel.

10. Warranty and care

We do not warrant goods, because we sell a digital service. For the paid period we maintain the service with due care. Updates are included. Care: email and the Help module in the panel, with a reply on business days.

11. Complaints

Send complaints about the Site or the subscription to [email protected]. There is no address for shipping goods. We respond within 14 business days of a complete complaint.

12. Changes and final provisions

Material updates are published on the Site. Changes that do not require ERP contract acceptance (site information) take effect on publication. ERP account terms change under the panel terms (at least 14 days to terminate).

Polish law applies, including the Civil Code, the Act on electronic services and the Electronic Communications Law.
